These Spin+ Membership Terms (the “Terms”) set forth the terms and conditions that govern the Fold, Inc. (“Fold”, “we,” or “us”) Spin+ subscription and membership (the “Spin+ Membership”). By purchasing a Spin+ Membership, you are entering into a legal agreement between you (“Spin+ Member”, “you,” or “your”) and Fold. By clicking “accept” to purchase a Spin+ Membership, you agree to be bound by these Terms. These Terms do not alter in any way the terms or conditions of any other agreement you may have with any other party for products, services, or otherwise.
Fold reserves the right to change or modify these Terms, including the cost of the Spin+ Membership (the “Membership Rate”) at any time and at our sole discretion. If Fold makes changes to these Terms, we will provide notice of such changes, by providing notice through the Services, as that term is defined in our Terms of Service, by e-mail and/or by updating these Terms https://foldapp.com/legal/terms-of-service (as indicated by the “Last Updated” date found at the top of these Terms). You agree to receive notifications through these means and your continued use of the Services will indicate your acceptance of the revised Terms.
IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY CANCEL YOUR MEMBERSHIP.
Fold reserves the right to refuse or terminate all or part of our Spin+ Membership to anyone for any reason in our sole discretion.
Once you select to purchase a Spin+ Membership using your Fold Visa Prepaid Debit Card Account (“Fold Prepaid Card” or your “Fold Card”), you agree to have your Fold Card debited based on the Membership Rate fee plan you select (the “Fee Plan”) on a recurring basis.
When you buy a Spin+ Membership, you'll be charged the Membership Rate according to your selected Fee Plan on the date of your purchase of Spin+ Membership, which activates the Spin+ Membership. Unless you cancel, you'll be charged according to your selected Fee Plan in successive equal intervals as stated in these Terms based on the purchase and registration date on your selected payment method. BY DEFAULT (AND WITH PRIOR NOTICE TO THE EXTENT REQUIRED BY APPLICABLE LAW), YOUR SPIN+ MEMBERSHIP WILL AUTOMATICALLY RENEW AT THE BEGINNING OF EACH SPIN + MEMBERSHIP FEE PLAN CYCLE, AND THE MEMBERSHIP RATE WILL BE AUTOMATICALLY CHARGED TO YOUR FOLD CARD. If you do not want your Spin+ Membership to renew automatically, you can cancel your subscription in accordance with Section 3 below.
If there is no balance on your Fold card, the payment will be declined, Fold may reattempt your payment, but reserves the right to terminate any unpaid periods in your Spin+ Membership with no further charges to you. Fold and its affiliates are not responsible for any fees your bank charges, including, but not limited to, overdraft fees, insufficient funds fees, interest charges, foreign exchange fees, cross-border fees, and other penalties levied by the payment methods bank.
You may cancel your Spin+ Membership up to two business days prior to your next scheduled payment to avoid further charges. To do this, contact support to cancel your membership at support@foldapp.com.
If you cancel your Renewable Membership, you will still have access to your Membership Benefits until the end of the current Fee Plan. All payments are non-refundable and non-transferable and will not be refunded on a pro-rata basis for any cancellation initiated by you during the Fee Plan period.
Fold may offer some members a free trial or other promotional subscriptions to a Spin+ Membership. Such trial or promotional subscriptions are subject to these renewable Membership Terms except as otherwise stated in your offer. Only one trial or promotional subscription is available per member. Free trial eligibility is determined by Fold at its sole discretion and Fold may limit such eligibility or duration to prevent free trial abuse. Certain limitations may exist with respect to combining a free trial with any other offers.
For some trials or promotional subscriptions, we require you to provide your payment details to start the trial or promotional subscription. BY PROVIDING SUCH DETAILS YOU AGREE THAT AT THE END OF YOUR APPLICABLE FREE TRIAL OR PROMOTIONAL SUBSCRIPTION PERIOD, YOUR SPIN+ MEMBERSHIP WILL AUTOMATICALLY RENEW AND YOU WILL BE CHARGED THE MEMBERSHIP RATE STATED IN YOUR OFFER AT THE BEGINNING OF EACH FEE PLAN UNTIL YOU CANCEL YOUR RENEWABLE MEMBERSHIP. IF YOU DO NOT WANT THIS CHARGE, YOU MUST CANCEL THE APPLICABLE TRIAL OR PROMOTIONAL SUBSCRIPTION BEFORE THE END OF THE TRIAL OR PROMOTIONAL SUBSCRIPTION IN ACCORDANCE WITH SECTION 3 ABOVE.
Spin+ Members receive the following benefits, which may be revised from time to time at our sole discretion.
Spin+ Membership rates may be changed at any time, may be limited to a single use and limited to certain products sold by Fold, and may not be combined with each other or with most other Fold offers or credits.
We may exclude products, features, or benefits from the Spin+ Membership at our discretion. The Spin+ section of our Help pages provides additional information about membership and benefits and may be updated from time to time.
If you received a free Spin+ Membership with your Fold Prepaid Debit Card Account, you may only obtain the Spin+ Membership discount rates on purchases of Gift Cards in the Fold App that utilizes your Fold Card Account. Purchases made on Fold using other payment methods will not be eligible for Spin+ Membership discount rates.
Fold reserves the right to modify or stop offering the Spin+ Memberships or change Membership Rates or Membership Benefits, at any time in its sole discretion. In the event Fold increases the Membership Rate of a Spin+ Membership Subscription, we will provide you with thirty (30) days prior notice via email before such changes take effect. All changes will be effective upon your next selected Fee Plan billing date, but if you do not agree with the price change, you have the right to reject the new Membership Rate and may avoid these charges by canceling your Spin+ Membership according to the instructions in Section 3 above.
Fold may terminate your Spin+ Membership at our discretion without notice. If that happens, Fold will give you a pro-rated refund based on charges already applied to your current billing period. We will not give any refund for termination related to conduct that we determine, in our sole discretion, violates these any of our Terms, any applicable law, or involves fraud or misuse of the Spin+ Membership.
We may send you email, and other communications related to Spin+ Membership (regardless of any settings or preferences related to your Spin+ account).
You may not transfer or assign your Spin+ Membership or any benefits thereof, including promotion codes for Spin+ Memberships or benefits, except as allowed in these terms. Spin+ Members are not permitted to purchase products for the purpose of resale, rental, or to ship to their customers or potential customers using their Spin+ Membership benefits.
