Fold, Inc. and its affiliates, issuing bank partners, custodial and exchange service providers, and third party service providers (collectively, “Fold,” “we,” “our,” or “us”) may need to provide you with certain communications, notices, agreements, billing statements, regulatory disclosures, or other information required by law in writing (“Communications”) regarding our website, mobile app, products, and services (“Services”). “Services” includes, without limitation, the Fold mobile application, the Fold website, the Fold Bitcoin Credit Card, the Fold Prepaid Debit Card, Bitcoin exchange and purchase services, Bitcoin gift cards, the Bitcoin Employee Bonus Program, the Spinwheel, and any other products or services we may offer from time to time. Your agreement to this E-sign Consent confirms your ability and consent to receive Communications electronically from Fold, its affiliates, and its third party service providers, rather than in paper form, and to the use of electronic signatures in our relationship with you (“Consent”). If you choose not to agree to this Consent or you withdraw your consent, you may be restricted from using the Services.
Under this Consent, Fold may provide all Communications electronically by email, by text message, by push notification, by in-app or secure portal messaging, or by making them accessible via Fold websites or applications, or by any other electronic means consistent with applicable law. Communications include, but are not limited to, the following categories of records:
We may also use electronic signatures and obtain them from you as part of any of the foregoing Communications or in connection with any transaction or agreement related to the Services.

By accessing and completing this Consent electronically, you confirm that your system meets the requirements described above and that you are able to receive, access, and retain Communications in electronic form. We reserve the right to send you Communications in paper form at any time, even if you have consented to receive Communications electronically.
If our hardware or software requirements change such that there is a material risk that you would not be able to access or retain electronic Communications, we will notify you of the revised requirements. Following such notification, you will have the right to withdraw your consent to receive electronic Communications without the imposition of any fees or conditions that were not previously disclosed. If you do not provide your affirmative consent to the new requirements within the timeframe specified in the notice, we may treat your failure to respond as a withdrawal of consent.
You have the right to receive Communications in paper form. To request a paper copy of any Communication, please write to Fold, Inc., 2942 North 24th Street, Suite 115, #42035 Phoenix, Arizona 85016, Attn: Customer Support (“Fold Address”) within 180 days of the date of the Disclosure, specifying in detail the Communication you would like to receive. A fee may apply for copies of paper Communications. For the avoidance of doubt, requesting a paper copy of any Communication, in and of itself, will not be treated as withdrawal of consent to receive electronic Communications.
You may withdraw your consent to receive electronic Communications at any time by writing to the Fold Address, by emailing support@foldapp.com, or by contacting us through the Fold mobile application. Withdrawal of your consent to receive electronic Communications may result in restricted access to, or termination of, some or all of the Services. Specifically, withdrawal of consent may result in:
There is no fee for processing the withdrawal of consent itself. Any withdrawal of your consent will be effective after a period of not more than ten (10) business days following our receipt of your request. During the processing period, Communications may continue to be delivered electronically. Withdrawal of your consent will not affect the legal validity or enforceability of any Communication previously provided to you electronically. Fold will confirm your withdrawal of consent and its effective date in writing.
You are responsible for keeping your email address, phone number, and other contact information current with Fold. You may update your contact information through the Fold mobile application, by emailing support@foldapp.com, or by writing to the Fold Address. Fold shall not be liable for any delay or failure to deliver Communications resulting from an inaccurate or outdated email address, phone number, or other contact information provided by you.
Communications sent to you electronically will be deemed received by you: (a) if sent by email, on the date sent to the email address associated with your Fold account; (b) if posted to the Fold website or mobile application, on the date first made available to you; (c) if sent by push notification, on the date the notification is sent to your device; and (d) if sent by text message, on the date transmitted to the phone number associated with your Fold account. It is your responsibility to check your email, the Fold mobile application, and other electronic channels for Communications on a regular basis. Standard carrier message and data rates may apply to Communications delivered via text message or push notification.

You acknowledge and agree that your consent to receive electronic Communications is provided in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq.) (“E-Sign Act”), and that you and Fold both intend that the E-Sign Act apply to the fullest extent possible to validate our ability to conduct business with you electronically.
