These Spin+ Membership Terms (the “Terms”) set forth the terms and conditions that govern the Fold, Inc. (“Fold”, “we,” or “us”) Spin+ subscription and membership (the “Spin+ Membership”). By purchasing a Spin+ Membership, you are entering into a legal agreement between you (“you,” or “your”) and Fold. By clicking “accept” to purchase a subscription, you agree to be bound by these Terms. These Terms do not alter in any way the terms or conditions of any other agreement you may have with any other party for products, services or otherwise.
Fold reserves the right to change or modify these Terms, including the cost of the Spin+ Membership (the “Membership Rate”) at any time and in our sole discretion. If Fold makes changes to these Terms, we will provide notice of such changes, by providing notice through the Services, by e-mail and/or by updating these Terms (as indicated by the “Last Updated” date found at the top of these Terms). You agree to receive notifications through these means and your continued use of the Services will indicate your acceptance of the revised Terms. If you do not agree to any amended Terms, you must stop using the Services.
IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY CANCEL YOUR MEMBERSHIP.
Fold reserves the right to refuse or terminate all or part of our Spin+ Membership to anyone for any reason in our sole discretion.
Once you select to purchase a Spin+ Membership using Fold Visa Prepaid Debit Card Account or Fold Credit Card (whichever you choose being your “Fold Card”), you agree to have your Fold Card charged based on the offer you select (the “Billing Cycle”) on a recurring basis.
If you have a Fold App account, you can inquire about purchasing a Spin+ membership by reaching out to customer support at email@example.com.
When you buy a Spin+ Membership, you'll be charged the Membership Rate for your first Billing Cycle on the date of purchase, which activates the Spin+ Membership. Unless you cancel, you'll be charged at the Billing Cycle stated in your Spin+ Membership Offer based on the initial purchase date on your selected payment method. BY DEFAULT (AND WITH PRIOR NOTICE TO THE EXTENT REQUIRED BY APPLICABLE LAW), YOUR SPIN+ MEMBERSHIP WILL AUTOMATICALLY RENEW AT THE BEGINNING OF EACH BILLING CYCLE, AND THE MEMBERSHIP RATE WILL BE AUTOMATICALLY CHARGED TO YOUR SELECTED PAYMENT METHOD. If you do not want your Spin+ Membership to automatically renew, you can cancel your subscription in accordance with Section 3 below.
If you select your Fold Card as your method of payment, you may be required to provide a secondary method of payment. In the event that there is an insufficient balance on your Fold Card accessible to complete your Spin+ Membership payment for any Billing Cycle for which you have selected your Fold Card as your method of payment, your secondary method of payment will be charged the remaining balance.
If your selected payment method is declined, Fold will prompt you for a new payment method but reserves the right to terminate any unpaid periods in your Spin+ Membership with no further charges to you. Fold and its affiliates are not responsible for any fees charged by the your bank including, but not limited to, overdraft fees, insufficient funds fees, interest charges, foreign exchange fees, cross border fees, and other penalties levied by the cardholder's bank.
You may cancel your Spin+ Membership within the Fold App up to 48 hours prior to your next scheduled payment to avoid further charges. All payments are non-refundable and non-transferable, and will not be refunded on a pro-rata basis for any cancellation initiated during a Billing Cycle.
Fold may offer some users a free trial or other promotional subscriptions to a Spin+ Membership. Such trial or promotional subscriptions are subject to these Renewable Membership Terms except as otherwise stated in your Offer. Only one trial or promotional subscription is available per user. Free trial eligibility is determined by Fold at its sole discretion and Fold may limit such eligibility or duration to prevent free trial abuse. Certain limitations may exist with respect to combining a free trial with any other offers.
For some trials or promotional subscriptions, we require you to provide your payment details to start the trial or promotional subscription. BY PROVIDING SUCH DETAILS YOU AGREE THAT AT THE END OF YOUR APPLICABLE FREE TRIAL OR PROMOTIONAL SUBSCRIPTION PERIOD, YOUR SPIN+ MEMBERSHIP WILL AUTOMATICALLY RENEW AND YOU WILL BE CHARGED THE MEMBERSHIP RATE STATED IN YOUR OFFER AT THE BEGINNING OF EACH BILLING CYCLE UNTIL YOU CANCEL YOUR RENEWABLE MEMBERSHIP. IF YOU DO NOT WANT THIS CHARGE, YOU MUST CANCEL THE APPLICABLE TRIAL OR PROMOTIONAL SUBSCRIPTION BEFORE THE END OF THE TRIAL OR PROMOTIONAL SUBSCRIPTION IN ACCORDANCE WITH SECTION 3 ABOVE.
Spin+ Members receiving the following benefits, which may be revised from time to time at our sole discretion.
Spin+ discount rates may be changed at any time, may be limited to a single use and limited to certain products sold by Fold, and may not be combined with each other or with most other Fold offers or credits. If a product is eligible for purchase with one or more discount benefits or rate that may still be used, the discount(s) will automatically be available as an option to apply to your order during checkout. Discount rates do not stack.
We may exclude products from the Spin+ discount benefit at our discretion. The Spin+ section of our Help pages provides additional information about membership and benefits and may be updated from time to time.
If you received a free Spin+ Membership with your Fold Prepaid Debit Card Account, you may only obtain the Spin+ discount rates on purchases on Fold that utilizes your Fold Prepaid Debit Card Account. Purchases made on Fold using other payment methods will not be eligible for Spin+ discount rates.
Fold reserves the right to modify or stop offering the Spin+ Memberships or change Membership Rates or Membership Benefits, at any time in its sole discretion. In the event Fold increases the Membership Rate of a Spin+ Membership, we will provide you with thirty (30) days prior notice via email before such changes take effect. All changes will be effective upon your next Billing Cycle, but if you do not agree with the price change, you have the right to reject the new Membership Rate and may avoid these charges by canceling your Renewable Membership according to the instructions in Section 3 above.
Fold may terminate your Spin+ Membership at our discretion without notice. If that happens, Fold will give you a pro-rated refund based on charges already applied to your current billing period. We will not give any refund for termination related to conduct that we determine, in our sole discretion, violates these any of our Terms, any applicable law, or involves fraud or misuse of the Spin+ Membership.
Fold reserves the right to modify these Spin+ Membership Terms. If we make material changes to the Spin+ Membership Terms while you have an active Spin+ Membership, we will notify you either in the via the Fold App and/or via email. Revised Spin+ Membership Terms become effective at the time the Terms are changed and your continued use of a Spin+ Membership constitutes your acceptance of the revised Spin+ Membership Terms. If you are not willing to agree to the revisions, you may cancel your Spin+ Membership in accordance with Section 3 above.
We may send you email and other communications related to Spin+ and your Spin+ membership (regardless of any settings or preferences related to your Spin+ account).
You may not transfer or assign your Spin+ membership or any Spin+ benefits, including promotion codes for Spin+ memberships or benefits, except as allowed in these terms. Spin+ members are not permitted to purchase products for the purpose of resale, rental, or to ship to their customers or potential customers using Spin+ benefits.
